INTRODUCTION. WIN AN OFFICIAL CHIVAS USA HONDA RIDGELINE SWEEPSTAKES (the "Sweepstakes"). Details of the prize and how to enter the Sweepstakes are contained in these Official Rules.
TO ENTER. TWO (2) WAYS TO ENTER: (i) Contestants may enter by completing an official entry form and depositing it into the official entry box located at the Home Depot Center in Carson, CA, during all Chivas regular season home games and also at Chivas USA grassroots and community events to be held throughout the greater Los Angeles area. LIMIT: one entry per person; or (ii) Sweepstakes can also be entered via mail by sending a postcard with your full name, age, e-mail address, phone number and date of entry to: "WIN A HONDA RIDGELINE, THE OFFICIAL TRUCK OF CHIVAS USA SWEEPSTAKES" c/o Anschutz Entertainment Group, Inc., 1100 S. Anschutz Entertainment Group, Inc. ("Sponsor"), Chivas USA Soccer, LLC ("Chivas USA"), and American Honda Motor Co, Inc. ("Honda") are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Sweepstakes entries, or for any error, human, technical or otherwise, which may occur in the processing of Sweepstakes entries. Proof of sending will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Limit one (1) entry per person.
TIMING. The Sweepstakes begins at 10:00 a.m. Pacific Standard Time on April 23, 2005 and ends at 2:00 p.m. Pacific Standard Time on October 16, 2005 (the "Promotion Period"). Entries received prior to or after the Promotion Period are disqualified.
USE OF DATA. Sponsor is entitled to use personal data contained in all entry forms, in accordance with the Sponsor's privacy policy accessible at http://www.staplescenter.com.
ELIGIBILITY. The Sweepstakes is only open to residents of California, who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Sponsor, Chivas USA, and Honda, or their respective affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners).
AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and to be contacted by telephone and/or email.
SELECTION OF POTENTIAL WINNER. Winner will be selected at random on or about November 15, 2005. Winner will be notified via telephone and/or email on or about November 15, 2005. Sponsor's decisions as to all matters related to administration of the Sweepstakes and selection of winner is final. Potential winner must comply with all terms and conditions set forth in these Official Rules, and winning and award of prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted within SEVENTY-TWO (72) hours after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place at random from all eligible entries received.
PRIZE: One (1) prize will be awarded consisting of a 2006 Honda Ridgeline RTS Truck featuring: 17" alloy wheels, body-colored mirrors and door handles, security system, dual-zone automatic climate control with air-filtration system, 8-way power driver's seat, manual lumbar support, 160-watt AM/FM/XM®-Ready/6-disc in-dash CD changer audio system with 7 speakers including subwoofer, exterior temperature indicator and steering wheel-mounted audio controls. Estimated Retail Value of Prize: $30,075. Winner is solely responsible for all applicable taxes, insurance costs, surcharges, registration, title, and license fees and other costs incurred in claiming, registering or using the vehicle, and operating and maintaining the vehicle. Vehicle includes standard features; any additional options, if available, are winner's responsibility. Interior and exterior color of vehicle is subject to availability and at the sole discretion of Honda. The year, make, model or color of any vehicle displayed or pictured in promotional/advertising materials may not be the actual vehicle awarded. Winner will be required to personally retrieve the vehicle from a local dealership or location as determined by Sponsor and at that time may need to provide valid driver's license, proof of insurance/registration and any necessary fees as outlined above Vehicle delivery/availability may take up to three (3) months. Failure to accept possession of vehicle within thirty (30) days of notification of deliver/availability may result in prize forfeiture. Winner acknowledges that the Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, merchantability, mechanical condition or fitness for any particular purpose, except for any express manufacturer's warranty as may be included with the prize. Odds of winning depend on the number of eligible entries received during the entire Promotion Period.
Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsors' sole and absolute discretion. Prize (and/or any portion thereof) is nontransferable and non-exchangeable. No substitutions or cash redemption of prize is permitted. Additional restrictions may apply.
GENERAL CONDITIONS. The Sweepstakes is governed by the laws of the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. Sweepstakes void where prohibited. Sweepstakes may only be entered in or from California and entries originating from any other jurisdiction are not eligible for entry.
Except where prohibited by law, Winner grants to Sponsor and its advertising agencies the right to use and publish Winner's photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Sweepstakes without additional compensation.
By entering, participants release, indemnify and hold harmless Sponsor, Chivas USA, and Honda, and their respective subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Sweepstakes or receipt or use and/or misuse of any prize.
Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or any other factor impairs the integrity of the Sweepstakes as determined by Sponsor in its sole discretion.
A potential winner may be requested to provide Sponsor with proof that the potential winner is a California resident. Prizes will only be awarded to eligible Winner.
If, in the Sponsor's opinion, there is any suspected or actual evidence of tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award the Prize in a random drawing from all eligible entries received before the time of cancellation.
Sponsor, Chivas USA and Honda in no way promote illegal acts, and any and all entries which include or promote illegal acts will be disqualified.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunctions or entry received by Sponsor on account of technical problems or otherwise.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Participants in the Sweepstakes hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the sweepstakes. Each participant and any guest of winner waive any and all objectives to jurisdiction and venue in these courts.
